1. Acceptance of Terms

Welcome to AstroKamya™ ("Platform," "we," "us," "our"), an AI-powered astrology and cosmic intelligence platform operated by AstroKamya Technologies. By accessing or using our website at astrokamya.com, mobile application, or any associated services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not access or use our Services. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

2. Description of Services

AstroKamya provides the following AI-powered services:

• Birth Chart Analysis: Vedic (Jyotish) and Western astrological chart generation based on date, time, and place of birth
• AI Predictions: Machine learning-powered predictions for career, relationships, health, and finance
• Compatibility Matching (SoulSync™): AI-driven compatibility analysis based on vedic astrology
• Daily/Weekly/Monthly Horoscopes: Personalized predictions based on planetary transits
• Consultations: AI-assisted and human-expert astrology consultations
• Cosmic Store: Gemstones, rudraksha, yantra, and spiritual products
• Life Tracker: Planetary transit tracking and personalized alert system

3. Astrological Disclaimers

3.1 Nature of Astrology

Astrology is a traditional belief system and interpretive art. It is NOT a scientifically proven discipline. The predictions, readings, analyses, charts, and recommendations provided through our Services are:

• Based on traditional Vedic (Jyotish) and Western astrological principles interpreted by AI/ML models and/or human astrologers
• For personal insight, self-reflection, and entertainment purposes only
• Not guaranteed to be accurate, reliable, or complete
• Subject to interpretation and may vary between astrologers and systems

3.2 Not Professional Advice

Our Services do NOT constitute and should NOT be relied upon as a substitute for:

• Medical advice: Do not use astrological predictions to make healthcare decisions. Always consult a qualified medical professional.
• Financial/Investment advice: Our predictions regarding wealth, career, or finances are not investment recommendations. Consult a SEBI-registered financial adviser.
• Legal advice: Consult a qualified advocate for legal matters.

3.3 User Responsibility

Any decisions or actions you take based on astrological readings, predictions, or recommendations from our Services are at your own sole risk and discretion. AstroKamya shall not be held responsible for any outcomes, losses, damages, or consequences arising from reliance on astrological content.

3.4 AI/ML Limitations

Our AI and machine learning models are trained on historical astrological data. They may:

• Produce results that differ from traditional human astrologer interpretations
• Contain errors, inaccuracies, or biases inherent in training data
• Not account for all astrological systems or regional variations
• Be updated or modified, which may change previous predictions

3.5 Product Recommendations

Gemstone, rudraksha, yantra, or spiritual product recommendations are based on traditional astrological beliefs and are not guaranteed to produce any specific result. We make no therapeutic, medicinal, or supernatural claims about our products.

4. User Accounts

4.1 Registration

To access certain features, you must create an account by providing accurate and complete information including: full name, email address and/or phone number, date of birth, time of birth, and place of birth (required for astrological calculations). You agree to keep your information accurate and updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at care@astrokamya.com of any unauthorized access.

4.3 Account Termination

We may suspend or terminate your account if you violate these Terms, provide false information, engage in abuse or fraud, or attempt to reverse-engineer our AI systems.

4.4 Account Deletion

You have the right to delete your account at any time through settings or by contacting us. Upon deletion, personal data will be erased within 30 days (subject to legal retention requirements), active subscriptions will be cancelled, and anonymous aggregated data may be retained for analytics.

5. Payments, Subscriptions & Refunds

5.1 Subscription Plans

AstroKamya offers tiered plans (Free, Stellar, Oracle, Cosmic) with varying features and AI reading limits. Details and pricing are displayed on our pricing page.

5.2 Payment Processing

Payments are processed securely through Razorpay. We do not store full credit/debit card details. All payment data is handled by PCI DSS-compliant processors.

5.3 Auto-Renewal

Subscriptions auto-renew unless cancelled at least 24 hours before renewal. You will be notified before each renewal.

5.4 Refund Policy

• Subscriptions: Cancel anytime. No refunds for the current billing period. Access continues until the period ends.
• AI Readings: Non-refundable once generated and delivered.
• Physical Products: Returnable within 7 days if materially different, damaged, or missing certification. Refunds processed within 7-10 business days.
• Consultations: Cancellations 24+ hours before schedule receive full refund. No-shows are non-refundable.

6. Acceptable Use

You agree NOT to:

• Use Services for any unlawful purpose
• Scrape, crawl, or harvest platform data without permission
• Reverse-engineer our AI/ML models or algorithms
• Redistribute or commercially exploit AI-generated readings
• Impersonate another person
• Introduce malware or disruptive code
• Use automated bots to access Services
• Harass, abuse, or threaten other users or staff
• Provide readings from our platform as your own professional services

7. Intellectual Property

All content, designs, logos, trademarks, AI models, algorithms, and software are owned by AstroKamya Technologies. "AstroKamya™," "SoulSync™," and related marks are trademarks. You retain ownership of personal data you provide. AI-generated content is for your personal use and may not be commercially redistributed.

8. Limitation of Liability

• AstroKamya shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages from your use of the Services
• This includes loss of profits, goodwill, data, or other intangible losses
• Total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim
• We do not warrant uninterrupted, error-free, or secure service

9. Indemnification

You agree to indemnify and hold harmless AstroKamya, its affiliates, officers, and employees from any claims, damages, and expenses arising from your use of the Services, violation of these Terms, or actions taken based on astrological content.

10. Third-Party Services

Our platform integrates with third-party services (Google, Facebook, Razorpay). These have their own terms. We are not responsible for third-party practices.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, including the Information Technology Act, 2000 and the DPDP Act, 2023. Disputes are subject to the exclusive jurisdiction of courts in Kolkata, West Bengal, India. Both parties agree to attempt good-faith negotiation for 30 days before filing legal action.

12. Modifications

We may update these Terms periodically. Material changes will be notified to users via email or in-app notification at least 15 days before taking effect.

If any provision is found unenforceable, remaining provisions continue in full force.
