1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Customer", "you") and AstroKamya™ ("Company", "we", "us", "our"), a proprietorship firm operated from Kolkata, West Bengal, India.

By accessing our website at astrokamya.com, creating an account, placing an order, or using any of our services (including the AI Jyotishi, Karma Score™, SoulSync™, and Destiny DNA™ features), you agree to be bound by these Terms, our Privacy Policy, and our Return, Refund & Shipping Policy.

If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately.

2. Eligibility

To use our Services and make purchases, you must:

• Be at least 18 years of age or have verifiable parental/guardian consent.
• Be competent to enter into a binding contract under the Indian Contract Act, 1872.
• Provide accurate, current, and complete information during registration and checkout.
• Not be a person barred from receiving services under the laws of India.

3. Account Registration

When you create an account on AstroKamya™, you agree to:

• Provide accurate and truthful birth details (date, time, and place of birth) for astrological calculations. Inaccurate birth details will result in inaccurate readings — we are not liable for readings based on incorrect information.
• Maintain the confidentiality of your login credentials and accept responsibility for all activities under your account.
• Notify us immediately at care@astrokamya.com if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for more than 24 months, or are used for fraudulent purposes.

4. Products & Services

4.1 Crystal Bracelets

AstroKamya™ sells handcrafted crystal and gemstone bracelets. Each bracelet is made with natural crystals that may exhibit minor variations in colour, size, pattern, and texture — this is a hallmark of genuine natural stones and not a defect. Product photographs on the Platform are representative; actual products may vary slightly.

4.2 Astrological Services

Our Platform offers AI-powered Vedic astrology features including birth chart generation (Kundali), Karma Score™ assessment, SoulSync™ compatibility analysis, and Destiny DNA™ personality profiling. These services are provided for informational, spiritual, and entertainment purposes only and do not constitute professional advice of any kind.

4.3 Product Availability

All products are subject to availability. We reserve the right to discontinue any product at any time without prior notice. If a product you ordered becomes unavailable after payment, we will notify you promptly and issue a full refund.

5. Pricing & Taxes

• All prices on the Platform are quoted in Indian Rupees (INR).
• Prices are inclusive of GST at 3% (applicable rate for gemstones and jewellery under HSN 7103/7113/7117).
• We reserve the right to modify product prices at any time. Price changes will not affect orders that have already been confirmed and paid for.
• Promotional discounts, coupon codes, and special offers are subject to their specific terms and conditions, and may be withdrawn at any time.

6. Payment Terms

We accept the following payment methods, all processed securely via Razorpay:

• UPI: Google Pay, PhonePe, Paytm, BHIM, and other UPI apps.
• Credit / Debit Cards: Visa, Mastercard, RuPay, American Express.
• Net Banking: All major Indian banks.
• Digital Wallets: Paytm, PhonePe, Amazon Pay (where available).
• Cash on Delivery (COD): Available for select PIN codes. A non-refundable advance of ₹149 is required at the time of order placement to confirm the order. The remaining amount is collected upon delivery.

Payment must be completed before order processing begins (except for the COD balance). Failed or disputed transactions will be resolved in accordance with Razorpay's dispute resolution process and RBI guidelines.

7. Orders & Cancellations

7.1 Order Confirmation

An order is considered confirmed only after successful payment processing and receipt of an order confirmation email/SMS from AstroKamya™. An order number will be assigned for tracking purposes.

7.2 Order Cancellation by Customer

• Orders may be cancelled within 12 hours of placement, provided the order has not been shipped.
• To cancel, email care@astrokamya.com with your order number and reason for cancellation.
• Refund for cancelled orders will be processed within 5–7 business days via the original payment method.
• COD advance (₹149) is non-refundable for cancellations made after the order has been dispatched.

7.3 Order Cancellation by AstroKamya

We reserve the right to cancel orders in the following circumstances:

• Product unavailability or stock-out after order placement.
• Pricing errors or system glitches resulting in incorrect pricing.
• Suspected fraudulent or duplicate orders.
• Unserviceable delivery location.
• Failure to verify COD orders (repeated failed delivery attempts).

In all such cases, a full refund will be processed within 5–7 business days.

8. Disclaimer — No Medical Claims

By purchasing our products, you acknowledge and agree that:

• Crystal healing is a complementary practice rooted in spiritual and cultural traditions. It is not a substitute for professional medical advice, diagnosis, or treatment.
• You should always consult a qualified healthcare professional before making any decisions related to your health or well-being.
• Any testimonials, reviews, or user experiences shared on the Platform reflect individual perspectives and do not guarantee similar results.
• Astrological readings and birth chart analyses provided through our Platform are for informational, spiritual, and entertainment purposes only and should not be used as the sole basis for life decisions.
• AstroKamya™ complies with the Advertising Standards Council of India (ASCI) guidelines and does not make any misleading health claims.

9. Intellectual Property

All content, trademarks, service marks, logos, trade names, designs, and intellectual property on the Platform are owned by AstroKamya™ or its licensors, and are protected under the Indian Trade Marks Act, 1999, the Copyright Act, 1957, and applicable international intellectual property laws.

9.1 Proprietary Marks

The following are registered or common law trademarks of AstroKamya™:

• AstroKamya™ — Brand name and logo
• Karma Score™ — Proprietary astrological assessment system
• SoulSync™ — Compatibility and relationship analysis feature
• Destiny DNA™ — Personality and life-path profiling system

9.2 Restrictions

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any content from the Platform without our prior written consent, except for:

• Temporary caching by your browser for personal, non-commercial use.
• Sharing product links on social media for personal, non-commercial purposes.
• Printing or downloading one copy of a reasonable number of pages for personal, non-commercial use.

10. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Attempt to gain unauthorised access to any portion of the Platform, other accounts, or computer systems.
• Use automated systems (bots, scrapers, crawlers) to access or extract data from the Platform without express written permission.
• Upload or transmit viruses, malware, or any harmful code.
• Engage in any activity that interferes with or disrupts the Platform's functionality.
• Post defamatory, abusive, harassing, or offensive content in reviews or communications.
• Resell or commercially exploit any products purchased from AstroKamya™ without prior written authorisation.

11. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• AstroKamya™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or products, including but not limited to loss of profits, data, goodwill, or other intangible losses.
• Our total cumulative liability to you for any and all claims arising from your use of the Platform or purchase of products shall not exceed the total amount paid by you to AstroKamya™ in the 12 months preceding the claim.
• We do not guarantee uninterrupted, error-free, or secure access to the Platform. The Platform is provided on an "as is" and "as available" basis.
• We are not liable for delays or failures caused by force majeure events, including natural disasters, pandemics, government actions, internet disruptions, or supply chain issues.

12. Indemnification

You agree to indemnify, defend, and hold harmless AstroKamya™, its owners, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:

• Your use of the Platform or products.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property rights.
• Any content you submit, post, or transmit through the Platform.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms, or any transactions on the Platform, shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
